A Corte estabeleceu que a execu\u00e7\u00e3o s\u00f3 poder\u00e1 alcan\u00e7ar quem integrou o processo desde a fase de conhecimento, restringindo significativamente a pr\u00e1tica, at\u00e9 ent\u00e3o comum, de inserir empresas do mesmo grupo econ\u00f4mico apenas na etapa execut\u00f3ria.<\/p>\n<p>Com a nova diretriz, eventuais correspons\u00e1veis devem ser identificados j\u00e1 na peti\u00e7\u00e3o inicial, mediante exposi\u00e7\u00e3o clara dos fundamentos legais que justificam sua inclus\u00e3o. A medida refor\u00e7a a necessidade de observ\u00e2ncia do contradit\u00f3rio desde o in\u00edcio da a\u00e7\u00e3o e impede amplia\u00e7\u00f5es casu\u00edsticas do polo passivo somente no momento do cumprimento da decis\u00e3o judicial.<\/p>\n<p>Foram mantidas apenas duas hip\u00f3teses excepcionais de redirecionamento da execu\u00e7\u00e3o a terceiros: sucess\u00e3o empresarial e abuso da personalidade jur\u00eddica, esta \u00faltima mediante instaura\u00e7\u00e3o regular do incidente de desconsidera\u00e7\u00e3o. Fora desses cen\u00e1rios, a responsabiliza\u00e7\u00e3o de empresas que n\u00e3o participaram da fase cognitiva fere o devido processo legal.<\/p>\n<p>A decis\u00e3o tem efeito imediato e alcan\u00e7a execu\u00e7\u00f5es em curso, inclusive aquelas em que o redirecionamento ocorreu antes da Reforma Trabalhista. Permanecem preservados apenas os casos com tr\u00e2nsito em julgado, cr\u00e9ditos j\u00e1 satisfeitos e execu\u00e7\u00f5es definitivamente arquivadas, o que amplia substancialmente o alcance pr\u00e1tico do entendimento e abre margem para revis\u00f5es de atos constritivos ainda vigentes.<\/p>\n<p>O julgamento tamb\u00e9m reposiciona o debate sobre a desconsidera\u00e7\u00e3o da personalidade jur\u00eddica no \u00e2mbito trabalhista, exigindo comprova\u00e7\u00e3o concreta de abuso ou sucess\u00e3o e afastando a antiga l\u00f3gica de responsabiliza\u00e7\u00e3o autom\u00e1tica baseada exclusivamente na exist\u00eancia de grupo econ\u00f4mico.<\/p>\n<p>Diante desse novo cen\u00e1rio, empresas inclu\u00eddas tardiamente em execu\u00e7\u00f5es passam a ter fundamentos s\u00f3lidos para contestar sua perman\u00eancia no polo passivo e reavaliar medidas j\u00e1 adotadas.
